Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Die Lustris ("we," "our," or "us") regarding your access to and use of the dielustris.com website (the "Site") and the purchase of products through our Site.

By accessing or using our Site, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these Terms, you may not access our Site or purchase products from us.

Eligibility

You must be at least 18 years old to make purchases on our Site. By making a purchase, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

Use of Site

You may use our Site only for lawful purposes and in accordance with these Terms. You agree not to:

Use the Site in any way that violates any applicable federal, state, local, or international law or regulation
Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site
Attempt to interfere with, compromise the system integrity or security of, or decipher any transmissions to or from the servers running the Site
Upload or transmit viruses, worms, or any other code of a destructive nature
Use any automated system, including "robots," "spiders," or "scrapers," to access the Site
Impersonate or attempt to impersonate Die Lustris, a Die Lustris employee, another user, or any other person or entity
Attempt to gain unauthorized access to any portion of the Site

Product Information and Pricing

We strive to provide accurate product descriptions, images, and pricing. However:

Product colors may vary slightly from images due to monitor settings and lighting
All measurements are approximate
Prices are subject to change without notice
We reserve the right to correct any pricing errors
All prices are in USD

We reserve the right to refuse or cancel any order for any reason, including product availability, errors in product or pricing information, or suspicion of fraudulent activity.

Orders and Payment

When you place an order, you agree to provide current, complete, and accurate purchase and account information. You agree to promptly update your account and payment information to keep it current and complete.

Order Acceptance: Your receipt of an order confirmation does not constitute our acceptance of your order. We reserve the right to accept or decline your order for any reason.

Payment Processing: Payment is processed securely through our payment processor (Stripe). We do not store your full credit card information on our servers. By providing payment information, you authorize us to charge the total amount to your payment method.

Sales Tax: Applicable sales tax will be calculated and collected at checkout based on your shipping address.

Print-on-Demand Production

All Die Lustris products are made-to-order using a print-on-demand model. This means:

Each item is custom-made for you after you place your order
Production typically takes 3-7 business days before shipping
Orders cannot be canceled once production has begun
Production begins shortly after your order is placed and payment is confirmed

Due to the custom nature of our products, we cannot accept returns for change of mind or incorrect size selection. Please review our Returns & Exchanges Policy for information about defects and misprints.

Shipping and Delivery

Shipping times are estimates and not guarantees. We are not responsible for delays caused by shipping carriers, customs, weather, or other circumstances beyond our control.

Current Shipping: We currently ship within the United States only. Standard shipping is free. See our Shipping Policy for details.

Risk of Loss: Title to products and risk of loss pass to you upon delivery to the shipping carrier.

Intellectual Property Rights

The Site and its original content, features, and functionality are owned by Die Lustris and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Trademarks: The Die Lustris name, logo, and all related product and service names, design marks, and slogans are trademarks of Die Lustris. You may not use these marks without our express prior written permission.

Limited License: We grant you a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. This license does not include any right to resell or commercial use of the Site or its contents.

User Content

If you submit content to our Site (such as stories, reviews, or comments), you grant Die Lustris a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media.

You represent and warrant that you own or have the necessary rights to submit such content and that your submission does not violate any third-party rights or applicable laws.

Disclaimer of Warranties

THE SITE AND PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, DIE LUSTRIS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

The Site will function uninterrupted, secure, or error-free
Defects will be corrected
The Site is free of viruses or other harmful components
Results from using the Site will meet your expectations

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DIE LUSTRIS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL DIE LUSTRIS'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO DIE LUSTRIS FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Die Lustris and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Idaho, United States, without regard to its conflict of law provisions.

Jurisdiction: You agree that any legal action or proceeding relating to these Terms or your use of the Site shall be instituted in a state or federal court located in Idaho. You agree to submit to the personal jurisdiction of such courts and waive any objection to venue in such courts.

Informal Resolution: Before filing a claim, you agree to try to resolve the dispute informally by contacting us. We'll try to resolve the dispute informally by contacting you.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

Entire Agreement

These Terms, together with our Privacy Policy and Returns & Exchanges Policy, constitute the entire agreement between you and Die Lustris regarding the use of the Site and supersede all prior agreements and understandings.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the Site after any changes constitutes acceptance of the new Terms.
